Article 1: General provisions
The e-commerce website of ATR Superstore, a BV with its registered office at Biesdelle 3 3980 Tessenderlo, VAT BE 0758.729.743, RPR ATR Superstore, (hereinafter "ATR") offers its customers the opportunity to purchase the products from its webshop online. These Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via ATR's webshop, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless previously, in writing and expressly accepted by ATR.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other duties or taxes to be borne by the Customer. If delivery, reservation or administrative costs are charged, this will be stated separately on the website.
The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.

Article 3: Offers

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind ATR. ATR is as far as the correctness and completeness of the offered information only bound to an obligation of means. ATR is in no case liable in case of manifest material errors, typesetting or printing errors.
If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request the Customer to contact our customer service department in advance.
The offer is always valid while stocks last and can be modified or withdrawn by ATR at any time. ATR cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this will be explicitly mentioned in the offer.

Article 4: Online purchases

You can place your order by placing all desired items in the shopping cart. If you then click on the shopping cart, you will see an overview of the products ordered, in which you can change quantities or remove items. When your order is complete, you can click on the "place order" button. In the next screen, you will be asked to enter your address details or you can log in with your personal account (e-mail address and password).

After your first order, you will receive an e-mail with instructions on how to create an account. With your next order, you can log in with it so that you do not have to enter your full address details every time and you will enjoy various benefits

ATR is entitled to refuse an order due to a serious shortcoming of the Customer with regard to orders involving the Customer.

Article 5: Delivery and execution of the agreement

Articles ordered via this web shop are delivered throughout Europe Delivery is made by professional transporters (UPS) Unless otherwise agreed or expressly stipulated, the goods are delivered to the Customer's place of residence within 30 days of receipt of the order.
Any visible damage and/or qualitative defect of an article or any other shortcoming in the delivery must be notified by the Customer to ATR without delay.
The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by ATR.
Article 6: Retention of title
The delivered goods remain the exclusive property of ATR until full payment by the Customer. The Customer agrees to point out the retention of title of ATR to third parties if necessary, e.g. to anyone who comes to seize the not yet fully paid items.

Article 7: Right of Withdrawal and Returns

7.1 Right of Withdrawal

  • Consumers have the right to withdraw from the contract within 14 calendar days after receipt of the goods, without giving any reason.
  • The customer shall notify ATR Superstore of the withdrawal by means of an unambiguous statement (by post or e-mail). A model withdrawal form is available (see appendix).
  • The goods must be returned or handed over to ATR Superstore within 14 days after notification of the withdrawal.
  • Only unused items in their original condition and packaging, including labels, accessories and proof of purchase, will be accepted.
  • Items purchased in the sale or with a discount cannot be returned.
  • Returns of these items are only possible after prior agreement with ATR Superstore.
  • In such cases, at least the shipping costs and any bank charges (for example PayPal fees) will be charged.
  • For unrealistic orders or cancellations before the items have been shipped, an प्रशासन fee of €25 will be charged, unless otherwise agreed with ATR Superstore.

7.2 Return Costs

The customer is responsible for the return shipping costs, unless otherwise agreed in writing with ATR.If the customer wishes to use a return label provided by ATR, a fixed fee of €25 (administration and shipping costs) will be charged. This amount will be automatically deducted from the refund.

7.3 Exchanges

For exchanges, the customer must return the item at their own expense according to the above return conditions.ATR will ship the replacement item free of charge with a new order valued above €300.If the amount is below €300, standard shipping costs apply.

7.4 Exclusions

The right of withdrawal does not apply to:

  • goods made according to the customer's specifications or intended for a specific person;
  • sealed goods that cannot be returned for reasons of hygiene or health protection and whose seal has been broken after delivery;
  • goods that, by their nature, are inseparably mixed with other products;
  • digital content not supplied on a physical medium, once the performance has begun with the customer’s consent;
  • services that have already been fully performed.

 

Article 8: Guarantee

Pursuant to the Act of 21 September 2004 of "de bescherming van de consumenten bij verkoop van consumptiegoederen", consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.
To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer's home, the Customer must contact ATR customer service and return the item to ATR at the Customer's expense.
If a defect is detected, the Customer must inform ATR as soon as possible. In any case, any defect must be notified by the Customer within 2 days after receipt. Thereafter any right to repair or replacement expires.

All warranty cases must be delivered to ATR Superstore, Biesdelle 3 3980 Tessenderlo Belgium. Collection of all warranty cases also takes place at ATR Superstore, Biesdelle 3 3980 Tessenderlo Belgium. Here the items are viewed together and approved by the customer. If they need to be sent, the shipping costs are for the customer and can only be adjusted in consultation with ATR Superstore.
The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.
Defects that manifest themselves after a period of 2 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.

Article 10: Penalties for non-payment 

Without prejudice to the exercise of other rights available to ATR, in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without warning, to pay interest of 10% per annum on the unpaid amount from the date of default. Furthermore, the Customer shall be liable, ipso jure and without warning, to pay a fixed compensation of 10% on the amount in question, with a minimum of €25 per invoice. Without prejudice to the foregoing, ATR reserves the right to take back items that have not been paid for (in full).

Article 11: Privacy

The controller, ATR Superstore respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data. The personal data communicated by you will only be used for the following purposes: Tracing for shipment of purchased items, mail. You have a legal right to access and, if necessary, correct your personal data. Subject to proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge by sending a written, dated and signed request to ATR, info@atrsuperstore.com. If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant. In case of use of data for direct marketing: You can oppose the use of your data for direct marketing free of charge. To do so, please contact ATR Superstore BV, info@atrsuperstore.com. We treat your data as confidential information and will not pass it on, rent it out or sell it to third parties. The customer himself is responsible for keeping his login data confidential and for the use of his password. Your password is stored encrypted, so ATR does not have access to your password.

Article 13: Invalidity - non-enforcement

If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.
The failure at any time by ATR to enforce any of the rights enumerated in these Conditions, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Article 14: Modification of conditions

These Conditions are supplemented by other conditions explicitly referred to and the general terms and conditions of sale of ATR. In case of contradiction, these Terms and Conditions shall prevail.

Article 15: Proof

The Customer accepts that electronic communications and backups may serve as evidence.

Article 16: Applicable law - Disputes

Belgian law shall apply, with the exception of the provisions of international private law on applicable law. The courts of the Consumer's domicile have jurisdiction in the event of legal disputes. The Consumer can also turn to the ODR platform http://ec.europa.eu/consumers/odr/
